FoodWhisp is a software platform for restaurant websites and ordering — not a restaurant or food delivery company. Please read these terms before creating an account or placing an order.

1. About FoodWhisp

FoodWhisp is a software platform operated by DevWhisp. We provide tools that let restaurants create and manage their own websites, connect custom domains, publish menus and deals, set opening hours, and receive orders from customers who visit those restaurant websites or use the FoodWhisp mobile app.

FoodWhisp is not a restaurant, food manufacturer, caterer, or food delivery company. We do not prepare, cook, package, sell, or deliver food. Each restaurant using our platform is an independent business responsible for its own menu, pricing, food quality, hygiene, fulfillment, and customer service.

2. Accounts

Restaurant owners may create an account on our website to subscribe to and use the platform. Customers may create an account in the mobile app to browse restaurants, place orders, and manage their profile.

You must provide accurate information, keep your login credentials secure, and be responsible for activity under your account. You must be at least 18 years old (or the age of majority where you live) to create an account.

3. Restaurant subscriptions

Restaurants access FoodWhisp features through a monthly (or other billed-interval) subscription. Features may include building a restaurant website, linking a domain, managing menus and deals, setting opening hours, configuring delivery or pickup details, and receiving orders.

Subscription fees are charged through our payment provider (currently Safepay). Plan prices shown at checkout are the amounts you agree to pay. Domain purchase, renewal, and related registrar fees are separate from the software subscription when applicable.

You may cancel a subscription according to the Refund, Cancellation & Delivery Policy. Canceling stops future billing according to that policy; it does not automatically refund past periods already paid.

4. Restaurant responsibilities

Restaurants using the platform are solely responsible for:

  • All food and drink they offer, including ingredients, allergens, quality, safety, and compliance with local health and licensing laws.
  • Menu accuracy, prices, deals, photos, and descriptions published on their site.
  • Opening hours, delivery areas, fees, pickup readiness, and order fulfillment.
  • Handling customer complaints, refunds for food orders, and any disputes arising from their products or service.
  • Content they upload (text, images, logos) and ensuring they have rights to use it.

5. Customer orders and food disclaimer

When a customer places an order through a restaurant’s FoodWhisp-powered website or the mobile app, the order is placed with that restaurant — not with FoodWhisp. The restaurant prepares and delivers (or makes available for pickup) the food.

FoodWhisp does not control food preparation, storage, transport, or handling. We are not responsible for food that is late, incorrect, incomplete, spoiled, contaminated, or that causes illness, allergic reaction, injury, or any other health issue. Any claim related to food quality or safety must be directed to the restaurant that fulfilled the order.

Customers should review allergen and ingredient information with the restaurant when needed. If you have dietary restrictions or allergies, contact the restaurant before ordering.

6. Acceptable use

You may not misuse the platform, including by attempting unauthorized access, interfering with service, uploading unlawful or infringing content, harassing others, or using the service for fraud or spam. We may suspend or terminate accounts that violate these terms.

7. Service availability

We aim to keep FoodWhisp available and reliable, but we do not guarantee uninterrupted or error-free service. Maintenance, outages, third-party failures (hosting, payments, DNS), or force majeure events may affect availability. We are not liable for lost sales or inconvenience caused by downtime beyond what applicable law requires.

8. Limitation of liability

To the fullest extent permitted by law, FoodWhisp and DevWhisp are not liable for: (a) food quality, safety, or health outcomes from any restaurant; (b) restaurant delivery or pickup failures; (c) disputes between customers and restaurants; (d) indirect, incidental, special, or consequential damages; or (e) loss of profits, data, or goodwill arising from use of the platform.

Our aggregate liability related to the software subscription for any restaurant is limited to the subscription fees paid to us for the three months preceding the claim, except where liability cannot be limited by law.

9. Changes

We may update these Terms from time to time. Continued use of the platform after changes become effective constitutes acceptance of the updated Terms. Material changes will be reflected on this page with an updated date.
